Man Robbed Outside Gun Store

Memphis police are searching for two men who ambushed another man and stole his newly purchased handgun outside a Summer Avenue retailer.

MPD spokeswoman Alyssa Macon-Moore said the men approached the victim inside Guns and Ammo at 3615 Summer Ave., this after he bought the new weapon and spoke with him briefly about the purchase. After the conversation, they parted ways, and the victim walked out to his car to stow the gun in the trunk.

The two men approached him again, police said, and took the gun at the point of another. One of the suspects trained his own handgun on the victim as the other shoved the man and grabbed his gun.-[source]

Massachusetts & California Fed Judges On 2A

A Federal Magistrate Judge in Massachusetts just outdid the Brady Center in their ludicrous interpretation of the United States Supreme Court Heller decision which declared that we have an individual, fundamental enumerated Constitutional right to carry a weapon for the purpose of self defense.

On October 14th, Judge Marrianne B. Bowler of Massachusetts ruled that the Second Amendment does not preclude laws or actions which are not “…tantamount to an absolute restriction on plaintiff’s right to possess firearms in his home.”

The Brady Bunch and their cohorts had been claiming that the Heller decision only conferred a right to keep firearms in ones home. According to this Massachusetts judge, even that interpretation is overly broad.

On May 11, 1997 Townsend Police and Massachusetts State Police seized a number of weapons owned by Harry Yohe. Yohe sued and was awarded $7,500. Since then, for the past thirteen and a half years, he has been trying to get his firearms returned, which the police have refused to do. The police will not even provide a list of his property that was seized.-[source]

SAF SUES HOLDER, FBI OVER 2A DENIAL

Acting on behalf of a Georgia resident and honorably discharged Vietnam War veteran, malady the Second Amendment Foundation today filed a lawsuit against Attorney General Eric Holder and the Federal Bureau of Investigation over enforcement of a federal statute that can deny gun rights to someone with a simple misdemeanor conviction on his record.

The lawsuit was filed in United States District Court for the District of Columbia. SAF and co-plaintiff Jefferson Wayne Schrader of Cleveland, GA are represented by attorney Alan Gura, who successfully argued both the Heller and McDonald cases before the U.S. Supreme Court.

In July 1968, Schrader, then 21, was found guilty of misdemeanor assault and battery relating to a fight involving a man who had previously assaulted him in Annapolis, MD. The altercation was observed by a police officer, who arrested Schrader, then an enlisted man in the Navy, stationed in Annapolis. The man he fought with was in a street gang that had attacked him for entering their “territory,” according to the complaint.-[source]

Congress To Clinton:Revisit Decision On M1′s

U.S. senators and representatives from both sides of the aisle are urging Secretary of State Hillary Rodham Clinton to revisit the State Department’s March 2010 decision disallowing the importation of M1 rifles and M1 carbines from South Korea.

In a letter to Secretary Clinton, viagra buy Sen. John Cornyn (R-Tex.) and 15 other senators state that the importation disapproval “amounts to no more than a backdoor gun ban that lacks any basis or justification under current Federal law and policy” and “violates law-abiding citizens’ constitutional right, medications protected under the Second Amendment, sale to purchase these firearms for legitimate purposes such as target shooting, hunting, collecting, and self-protection.”

The senators question the department’s opinion that the rifles “could potentially be exploited by individuals seeking firearms for illicit purposes,” and request from Secretary Clinton “an explanation of your reasons for blocking the importation and sale of American-made rifles from South Korea.”-[source]

Darpa’s Self-Aiming “One Shot” Sniper Rifle

A sniper crouches near an open window and zooms in on his target, who sits a half-mile away. He peers through a scope and holds his breath, preparing to squeeze the trigger. But it’s windy outside, and he can’t afford a miss. What to do?

A new DARPA-funded electro-optical system will calculate the ballistics for him, telling him where to aim and ensuring a perfect shot, no matter the weather conditions. – [source]

During the project’s first phase, which started in 2007, Lockheed developed a down-range system that measured average crosswind; range to target; spotter scope position; air temperature, pressure, and humidity; and more, according to Military Aerospace. Using all those variables, it calculated the ballistics for a .308 bullet at ranges as far as 3,600 feet.

While that’s impressive, the system was too heavy and unwieldy, and it couldn’t be used with standard rifle scopes. The phase two design will be more compact and able to operate in real time and over longer distances.

It will measure atmospheric conditions, account for the weapon’s maximum effective range and include GPS coordinates. It’s also supposed to communicate with the rifle scope, informing the gun itself of the aim point offset and expected crosswind.

Hidden Threat to Second Amendment

Recently the American Bar Association published a report urging:

[F]ederal, nurse state … governments to enact laws requiring that all newly-manufactured semi-automatic pistols be fitted with microstamping technology which would ensure that when a firearm is fired, site an alphanumeric and/or geometric code would be stamped on the cartridge casing … that would enable law enforcement to identify the serial number of the pistol and hence the first known purchaser of a weapon used in a crime.

To succeed, page microstamping requires building a permanent database of all gun owners (licensing) and linking their firearms by serial number (registration), two major goals  of gun control advocates.

Two law firms represent patent holders  that could make the ABA recommendation reality. They’ve spent $6.7 million on campaign contributions since 2004, while the entire gun rights lobby spent $6 million.

Texas Police Theft, ‘Gun Control’ Futility

“Gun shop owner gets probation for buying stolen guns, find ” Eyewitness News ABC 13 tells us.

An Humble gun shop owner will not be going to prison for his connection to the sale of guns stolen from the Cleveland Police Department.

Stolen from the police?  Who is in a position to do that?

[T]he proprietor of Sportsman’s Outlet and Gun Range in Humble, generic Texas, discount entered into a barter arrangement with Liberty County Sheriff’s Office Captain Harry Kelley.

In a separate indictment, Kelley is accused of stealing thousands of rounds of ammunition and hundreds of guns belonging to the Cleveland Police Department, which he in turn bartered, without further payment for the City of Cleveland, to [Gary] Lee. In exchange, Lee then provided scores of other new firearms that Kelley then resold under his Federal Firearms License.

Understandably, the government is portraying this as “an unacceptable blemish on the integrity of law enforcement in Liberty County.” Perhaps.  But what is also unacceptable is the systemic lack of controls and accountability that would lead anyone to think they could get away with such a scheme–repeatedly and over the course of years.-[source]

Utah Permitless CCW

Gun rights advocates in Utah are pushing a new law that would let residents carry loaded, concealed firearms in public without a permit.

In its newsletter this week, the Utah Shooting Sports Council listed the so-called “Constitutional carry” law as one of its top priorities for the 2011 Legislature, which convenes in January. The council says permits are “little more than bureaucratic permission slips” to exercise Second Amendment rights.

Rep. Stephen Sandstrom, R-Orem, who recently met with the group, intends to draft legislation that would render state-issued concealed carry permits unnecessary. And other lawmaker plans to run a bill in an attempt to regain the favor of states that have recently stopped recognizing Utah’s permits due to what they see as lax licensing requirements.

“Basically, the right to keep and bear arms is a personal right just like you have freedom of religion, freedom of speech,” Sandstrom said. “You don’t get a freedom of religion permit. As a reporter, you don’t get a First Amendment permit. So why guns?”-[source]

Pennsylvania “Castle Doctrine” Expansion Bill.

Is it self-defense — or wild, sildenafil Wild West?

This is the question Gov. Ed Rendell and state senators will consider with the Pennsylvania House’s passing of the controversial “Castle Doctrine” expansion bill.

House Bill 40 eliminates a citizen’s duty to retreat if threatened at home or in public and authorizes the use of lethal force against assailants.

State Rep. Carl Walker Metzgar, abortion R-Allegheny Township, said his office has already received a flood of phone calls and e-mails from Somerset County constituents who support the measure.

“They’re outraged that they could be civilly or criminally liable for protecting themselves,” Metzgar said.

Current law allows lethal force — without retreat — if the person is within his or her residence. The “Castle Doctrine” expansion bill extends this legal protection to citizens not only in their homes, but also in public.-[source]

Tea Party To Rally-Goers: Leave Guns At Home

Come to the rally, but leave the guns at home.  That’s the call to Tea Party members as they hold their big election event at Hi Corbett Field this Saturday.

At a Tea Party event this past August, even the candidates themselves packed heat on stage.  That won’t happen Saturday.

“The difference is that this one is actually going to be in a stadium so we’re subject to different rules and laws,” said Tucson Tea Party leader Trent Humphries.

They’re expecting around 7 thousand people, and a gun ban was recommended to keep control.

“There’s some people that are upset by that news and I understand,” he said, “I understand completely because we favor the second amendment, that’s a big thing but the police have some concerns too.”

Humphries says they shared some concern over big names in attendance like Sheriff Joe Arpaio, known for attracting counter-protestors.  We asked Arpaio what he thought.

“I was just down at the border at a rally in Cochise County in August and they had guns there all over the place,” he replied, “I’m not overly concerned.”

Arpaio says he’s used to angry crowds everywhere he goes.

“I usually go and face it, they scream at me, do everything they can with all their signs but that doesn’t deter me,” he said, “I’m not going to be deterred by Tucson.”

Humphries says the ban is not mandatory, but it was suggested by police.  Otherwise, they would have had to hire more officers for security.  He says that wasn’t economically feasible.

The rally will be Saturday, October 9 at Hi Corbett Field from 8a.m to 2pm.  It is free and open to the public.-[source]
